Joint tenancy means that the parties hold the property together as one undivided share and must conduct all future dealings with the property together. The survivor of the parties will also take the share of the deceased party upon their passing.


Tenancy-in-common means that the parties can choose to hold the property in whatever divide between 1/100 to 99/100. The parties will hold their shares in the property independently of each other. Each party’s ownership will also pass in accordance with their will upon their passing rather than automatically to the surviving party on title.


This includes the location of any storage lot or car parking that you may have been promised. If you cannot find your lot(s) on the plan, please contact us for further advice.

Financial settlement

If you are obtaining a loan or refinance, please provide the contact details of your banker or mortgage broker.

Shortfall facilities means a savings account held with the lender that is used for the purpose of debiting your contributions to top up the difference between the loan amount and the total settlement funds required. Please communicate with your lender to confirm that this is a service they can provide and provide the necessary authorities. Otherwise, you will need to transfer the required funds into our trust account.

Trust account is a bank account administered by a law practice such as ours to hold client funds. There are strict compliance requirements surrounding the administration of client’s funds, enacted for the protection of consumers. There is a fee of $149 (plus GST) billable for the service of administering your trust funds. To avoid this charge, please use your incoming lender’s shortfall facilities if available.
